Section 1. Purpose

1.1. The purpose of these Terms & Conditions (“Agreement”) is to  define the rights, responsibilities, limitations, disclaimers, and  governing provisions applicable to the use and provision of tarot  reading services (the “Services”) as offered by Banana Chips Tarot  (“Provider”).

Section 2. Definitions

For the purposes of this Agreement, the following terms shall have the meanings set forth below:

2.1. “Agreement” means these Terms & Conditions, including all sections,  subsections, disclaimers, policies, and amendments as may be updated  from time to time.
2.2. “Services” means tarot readings, interpretations, commentary, or related  activities provided by the Provider in any form or medium, whether live,  recorded, digital, written, or otherwise.
2.3. “Client” means any individual who purchases, views, or otherwise engages with the Services, directly or indirectly.
2.4. “Reading” means the process by which tarot cards are drawn, displayed, and  interpreted, together with any associated verbal or written commentary.
2.5. “Interpretation” means any statement, opinion, observation, speculation, or expression  offered by the Provider during or following a Reading, whether literal,  symbolic, metaphorical, or otherwise.
2.6. “Entertainment” means content intended for amusement, reflection, or narrative  purposes, and excludes factual prediction, professional advice, or  scientific analysis.
2.7. “Force Majeure” means events beyond the reasonable control of the Provider, including  but not limited to acts of God, natural disasters, labor disputes,  pandemics, war, civil unrest, technological failures, extraterrestrial  interference, or other extraordinary events.

Section 3. Professional Disclaimer

3.1. The Provider is not, and does not claim to be, a licensed  professional in medicine, psychology, law, finance, or any other  regulated industry.
3.2. The Services do not constitute, and shall not be construed as,  medical, legal, financial, therapeutic, or professional advice of any  kind.
3.3. The Client acknowledges that any resemblance of the Services to  professional advice is coincidental and without intent to mislead.

Section 4. Personal Responsibility

4.1. The Client affirms that they are at least eighteen (18) years of age at the time of purchase.
4.2. The Client acknowledges that all Readings and Interpretations are  inherently subjective, symbolic, and open to multiple understandings.
4.3. The Client accepts sole responsibility for all decisions, choices,  actions, omissions, or consequences arising from or associated with the  Services.
4.4. The Client releases and discharges the Provider from any claim,  demand, or liability related to emotional, financial, relational,  reputational, or other outcomes.

Section 5. Entertainment Disclaimer

5.1. The Services are provided exclusively for reflection, perspective, and entertainment purposes.
5.2. The Services shall not be deemed factual, predictive, verifiable,  or binding upon reality, the universe, or any third party.
5.3. The Provider makes no representation of supernatural ability, paranormal authority, or metaphysical guarantee.
5.4. The Client acknowledges that the Services are, in substance, a form of narrative or storytelling.

5.5. By participating, the Client understands that the Provider is not acting as a therapist, oracle, spiritual authority, or life consultant, but rather as a narrator of interpretive narrative expression whose primary duty is to provide an experience, not certainty.

5.6. The Client acknowledges that the Provider’s delivery, demeanor, and stylistic presentation of the Services may involve expressive dramatization, characterization, or performative affect, all of which are to be understood as components of a creative entertainment medium rather than assertions of personal belief, authority, or factual representation.

5.7. No Healing Guarantee.
The Provider does not claim to “heal,” “awaken,” “align,” or otherwise rehabilitate the Client’s "chakras", "aura", trauma, or life choices. The Services are designed for entertainment and emotional stimulation only. Any feelings of empowerment, catharsis, or sudden motivation to dump your ex are welcome side effects, not promised outcomes.   

Section 6. Refund Policy

6.1. All sales are final.
6.2. Due to the individualized and interpretive nature of the Services,  refunds, returns, cancellations, or exchanges will not be granted under  any circumstances

6.3.1. The Client acknowledges and agrees that the duration of any recorded video Reading is not fixed, guaranteed, or subject to minimum or maximum time requirements.

6.3.2. A Reading may be brief or extended in length (for example, approximately five (5) minutes or up to sixty (60) minutes or more), at the sole discretion of the Provider, depending on the interpretive material presented, the nature of the Reading, and the Provider’s creative and narrative process.

6.3.3. The Client understands that the value of the Services is not determined by the duration of the Reading, but by the interpretive experience provided.

6.3.4. Dissatisfaction with the length, depth, pacing, or perceived completeness of a Reading shall not constitute grounds for a refund, chargeback, dispute, or reversal of payment.

Section 7. Limitation of Liability

7.1. To the maximum extent permitted by applicable law, the Provider  disclaims liability for any direct, indirect, incidental, consequential,  exemplary, or special damages.
7.2. Such damages include, without limitation, financial loss, emotional  distress, interpersonal conflict, reliance losses, reputational harm,  or any other adverse outcome connected, directly or indirectly, to the  Services.

Section 8. International Use

8.1. The Services are made available to Clients worldwide, subject to this Agreement.
8.2. Clients who access or purchase Services from outside the United  States do so voluntarily and are solely responsible for compliance with  all applicable local laws, regulations, and restrictions.
8.3. The Client acknowledges and agrees that, regardless of their place  of residence, this Agreement shall be governed by the laws of the State  of Florida and the United States of America, without regard to  conflict-of-law principles.

8.4. The Provider shall not be liable for any taxes, tariffs, duties,  exchange rates, or limitations imposed by any foreign jurisdiction.

Section 9. Miscellaneous Provisions

9.1. Severability. If any provision of this Agreement is found invalid or unenforceable,  the remaining provisions shall remain in full force and effect.
9.2. Entire Agreement. This Agreement constitutes the entire understanding between Provider  and Client, superseding all prior communications, understandings, or  representations.
9.3. Amendments. The Provider reserves the right to amend or modify these Terms at any  time, without prior notice, and such amendments shall be binding upon  publication.
9.4. Force Majeure. The Provider shall not be liable for failure to perform obligations  under this Agreement due to events defined as Force Majeure.

Section 10. Agreement and Consent

By completing a purchase, the Client affirms that they have read,  understood, or otherwise acknowledged this Agreement, and consent to be  bound hereby, whether or not they have reviewed it in full.
